It's a pretty big gamble. He's an innkeeper, so he knows lots of people, knows all of the latest gossip, and is probably familiar with just about everyone in town. So he would make an incredibly useful ally. On the other hand, if he turns on you and reports you, you're pretty screwed for those same reasons.

The prince and his men are currently traveling across the island, heading toward the war front. They are scheduled to pass through this town on the way there, so the party is laying in wait for that day, which is in about a week or so.

I'm fine not actually making it have any effect against the guard if it would have been an action to sit/fall upon the guard.

Yeah, I believe to hold him down you'd need a grapple attack, which would take an action.
